The Athens Court of First Instance suspects infringement of intellectual property rights and grants provisional measures in favor of DIS.

DIS DYNAMIC INTEGRATED SOLUTIONS SA Informatics (“DIS“), a leading company in digital business transformation in Southeastern Europe, with more than 400 customers in 30 countries and awarded as Cloud Provider of the Year for three consecutive years (2021, 2022, 2023), informs about the legal actions it has taken due to copyright infringement.

DIS, which since 2006 has been innovating by developing business software with Greek added value, to which it has full intellectual property rights, has found a violation of its rights by the companies “Praktiker Hellas Commercial Limited Company” (“Praktiker Hellas”) and “Real Consulting Provision of Business IT Solutions Limited Company” (“Real Consulting”) and has taken legal action.

The Athens Court of First Instance, in its judgment No 4890/2024 (interim measures procedure), held that the above companies had infringed DIS’s intellectual property rights in the software programs provided by DIS under a contractual relationship with Praktiker Hellas.

In the same proceedings, the court had previously issued an interim injunction, pursuant to which the source code of the software used by the opposing parties had already been legally inventoried.

In the above-mentioned order, the court, having presumed that DIS’s intellectual property rights had been infringed, decided, inter alia, to prohibit Real Consulting from using the software in question in third companies, on a provisional basis and until a final judgment was delivered.

DIS, while retaining its rights, is bringing an action before the civil and criminal courts, seeking, on the one hand, compensation of several million euros from Praktiker Hellas and Real Consulting for the damage caused and, on the other hand, criminal punishment of any person responsible for the infringement of intellectual property rights.
